Terms and Condition for Advertisers and Visitors
 

1. Responsibility for accuracy and currency of property information
Spain Villa Rental accepts advertisements in good faith and expects that advertisers will provide an accurate description of their property. Spain Villa Rental make no representation as to the accuracy of this information about the property, its location nor its ownership. Spain Villa Rental takes all reasonable care to faithfully reproduce the text, prices, contact details and photographs provided to us by advertisers, however the property details content of this website remains the sole responsibility of the owner or agent of the property displayed. Spain Villa Rental has not confirmed the accuracy thereof and accordingly all users of this website are strongly recommended to make their own investigations into the authenticity of any information supplied.

Spain Villa Rental are in no way liable for any inaccuracies or misleading statements made in the information provided by the owner or agent of properties on the website, nor will we be held liable for any loss arising out of any error or omission on our part.

We advise against sending payment via Western Union, MoneyGram or similar service to someone you do not know personally. Unlike a bank transfer, the recipient remains anonymous and you will not be able to identify them if there is a problem. It is the users responsibility to obtain confirmation of all necessary information before parting with any monies and Spain Villa Rental accepts no responsibility for loss of deposits, part payments or any other monies under any circumstances.

2. Use of the site
A condition of your continued use of this website is that you agree not to use this website for any purpose that is unlawful or prohibited by these terms and conditions or by other applicable laws and regulations. Your continued use of the website also signifies that you indemnify Spain Villa Rental from any loss or damage or costs in connection with any breach of these conditions or any other legal obligation by you and your use of, or conduct on the site.

3. Copyright protection
It is the responsibility of the advertiser to ensure they have the right to reproduce any photographs or digital images which they supply to us. The advertiser agrees to indemnify Spain Villa Rental against all claims costs arising out of any infringement of copyright for such photographs or images. All digital images produced by Spain Villa Rental from images supplied by advertisers are the property of Spain Villa Rental, and shall not be reproduced without our permission.

4. Website design and layout
Spain Villa Rental reserves the right to amend the design and layout of the website, including the right to edit copy, or amend layouts or photographs supplied. Spain Villa Rental will not be held responsible for any loss, or damage, resulting from the design, or positioning, of the properties, or changes made to the photographs and copy submitted by the advertiser.

5. Liability
Spain Villa Rental does not warrant that the operation of this website will be uninterrupted or error free. In no event shall Spain Villa Rental be held liable for any loss or damages howsoever incurred, including consequential losses such as lost income, in connection with advertising on this website.

6. Privacy
Spain Villa Rental treats the personal information of users of this website with respect and confidentiality and takes reasonable steps to ensure that your personal information is stored securely and accurately. If you have any queries or comments about the policy or our use of your personal information, please contact us.

In general, the information collected from you is used to help our advertisers provide accommodation to all the users of this website. 7. How we use your information and who we share it with
We reserve the right to use and share information concerning our advertisers, including your Internet Protocol (IP) address, with law enforcement authorities and/or other companies in the same industry as Spain Villa Rental for the purpose of fraud prevention.

8. Multiple properties
A property advertisement on Spain Villa Rental pertains to one holiday unit, not multiple units, nor an example of properties in a certain location, unless prior permission has been given to the advertiser to amend this condition.  Where an advertiser wishes to advertise multiple properties in different locations, we charge our standard fee for the first property, plus 50% of our standard fee for each additional property. Any introductory special prices, terms and periods of advertising will not apply to additional properties unless agreed in writing advance.

9. Exchanging properties
A property advertisement on Spain Villa Rental relates to a specific property, and this property cannot be substituted for another by way of changes to the text and photographs unless prior permission has been given to the advertiser. If an advertiser is found to have changed the property being described, Spain Villa Rental reserves the right to suspend the advertisement in question.

10. Termination of a property page
If Spain Villa Rental receives substantiated complaints from a number of users of this website about a specific property description misrepresenting the property or its surroundings, then we reserve the right to remove the property from the website without notice. Spain Villa Rental constantly analyses property booking trends and listing placements to detect manipulation of the property listings. Any advertiser found to be manipulating their placement in the listings may have their property or properties removed from the website without notice.  In all cases our decision will be final. No refund will be given for any remaining unused period of the advertisement, and under no circumstances will any compensation be payable by Spain Villa Rental for any loss howsoever incurred, including loss of income, re-advertising costs etc.

If advertisers wish their property to be removed from the website before the end of their subscription, we will do this as soon as we receive formal notice from the advertiser by email, quoting their owner ID. Advertisers may also ask for their advertisement to be reinstated at any time during the period of advertising purchased. Please note that the period of advertising will not be extended to allow for the time when the advertisement was not listed on the website. No refunds will be given.

11. Contactability
In the interest of maintaining a high level of service to users of this website, we require all advertisers to be available to respond to enquiries by telephone or email. Should advertisers be unavailable for a period of more than 1 week, we ask them to set up an out-of-office response on their email account. If this option is not possible, we ask advertisers to contact us so we can temporarily suspend their advertisement.

12. External links
Spain Villa Rental will at its sole discretion include one link per advertisement to a personal website, which must relate only to the property advertised on the Spain Villa Rental website. We reserve the right to refuse such links, remove them without notice, or insert a "no-follow" html instruction in the source code. Spain Villa Rental will not add owners' email addresses to the advertisement under any circumstances since such a link will be open to spamming.

13. Right of refusal
Spain Villa rental reserves the absolute right to refuse to accept any advertisement submitted, without providing any reason.

14. Enquiry Forms Email
Enquiry forms are provided on each advertisement for the sole use of holiday-makers making genuine availability and booking enquiries. Spain Villa Rental monitor the use of these forms and may take action against anyone using them for purposes which we consider not to be genuine availability or booking enquiries or which constitute unsolicited commercial marketing.

15. Payment details
When a new property is added to the website, payment is due within 14 days. Advertisers may pay by bank transfer or by sending a cheque to the address notified from time to time. Spain Villa Rental reserve the right to remove property advertisements if payment is not received within this time.

16. Changes to pricing and conditions
Spain Villa Rental reserves the right to change the rates and conditions without notice. Any new rates will be applicable immediately for new advertisers and upon renewal for existing advertisers.

17. Special Offers
Spain Villa Rental reserves the right to offer special introductory prices, terms and periods of advertising, which may be withdrawn or amended at any time and without notice. Any such introductory offers will only be available to first-time advertisers, and only be applicable to the advertiser's first property on the website.
